Miami - On Friday, nearly 3,000 students, faculty and supporters staged a walk out from the North Miami High School in support of Daniela Peláez, 18, and marched to bring national attention to President Barack H. Obama's failed policy not to deport illegal students doing well in school. U.S. Immigration and Customs Enforcement (ICE) attorneys and supervisory personnel, including an immigration judge have apparently stray away from a policy directive from ICE Director John Morton and the Obama administration to use discretion and not to continue deportation proceedings of students doing well in school and non-criminals to prevent the separation of families.
A judge on Monday gave Peláez until the end of March to leave voluntarily or face mandatory deportation. She came to the U.S. from Colombia when she was only 4 and considers herself an American, but without documentation. Her attorney is appealing her immigration case, but for Peláez' case to get to this point only indicates that some immigration officials have failed to acknowledge that Peláez is not a criminal and does not fall under the current policy guidelines to be deported.
She applied for residency in 2010 and was denied. Her brother is in the U.S. Army and just finished a tour in Afghanistan. Her father gained residency through Peláez' brother.
Those supporting Peláez will continue their quest to have Peláez a senior and a valedictorian at North Miami High School stay in the U.S. and continue her education.
U.S. Representative Ileana Ros-Lehtinen on Friday sent a letter to ICE requesting a stay for Peláez and her sister.
